Technically that is incorrect. Part of the law is that any training or promotional opportunity that the individual would have had if he had not been deployed, he is entitled to when he returns from deployment. USERRA LINKUnfortunately the USERRA is enforced by volunteers that have no real legal authority to enforce it. Creating full time state or federal justice employee positions with authority to take corrective action would be a huge step in the right direction.
